Terms of Use 

 

1. Scope:

• These Terms and Conditions apply to all agreements and business relationships between Kristina Wieshofer and the customers.
• Deviating terms and conditions of the customer shall not be recognized unless expressly accepted in writing by Kristina Wieshofer.

1. Services:

• Kristina Wieshofer offers artistic services such as artworks and commissioned pieces.
• The specific services, prices, and delivery times will be agreed upon individually with the customer and documented in writing.

1. Prices and Payment Terms:

• The prices for the services provided by Kristina Wieshofer will be determined individually and communicated to the customer prior to the commission.
• Payments are due within the agreed timeframe from the date of invoice.
• Kristina Wieshofer retains ownership of the artwork until full payment has been received.

1. Delivery and Shipping:

• Delivery of the artworks will be arranged on an individual basis.
• Shipping costs may apply and will be communicated to the customer in addition to the purchase price.
• Kristina Wieshofer is not liable for damages or losses during shipping unless otherwise expressly agreed.

1. Copyright and Usage Rights:

• Kristina Wieshofer retains the copyright to all created artworks.
• Transfer of usage rights to the customer only occurs upon written agreement and corresponding compensation.
• Any reproduction, publication, or commercial use of the artworks requires prior written consent from Kristina Wieshofer.

1. Liability:

• Kristina Wieshofer is liable only for willful intent or gross negligence.
• Any further liability, especially for indirect or consequential damages, is excluded.

1. Right of Withdrawal:

• Due to the customized nature of the artworks, there is no right of withdrawal in accordance with applicable statutory provisions.

1. Jurisdiction and Applicable Law:

• In the event of disputes, the competent court in Vienna shall have exclusive jurisdiction.
• Austrian law shall apply.
